We purchased a 2008 Dodge Charger Daytona Edition from Ed Napleton Dodge in Oak Lawn, IL on Thursday, November 20, 2008 that we had initially found on EBay. According to the advertisement, the car was still under warranty from Chrysler 3/36 and Vortech 3/36, and also had the MSDS option needed to gain better gas mileage but would also have the power that we were looking for. This car did not have Navigation, Bluetooth, and they had removed the Daytona sticker from the bottom of the car. Prior to making the arrangements to purchase the car, Pete Schraeger (our salesman) assured us that he would have the sticker and both features (Navigation and Bluetooth) installed and that it would have everything the factory Navigation had but better. He also would have a sunroof installed and we agreed upon a trade in value for our 2007 Toyota Camry. Pete Schraeger also said that Ed Napleton Dodge is an authorized Vortech installer; in fact, Pete Schraeger had tuned the Supercharger on this car.
We arrived at the dealership in Oak Lawn, IL, and the car was still getting the Navigation system installed at a dealer-represented shop. We signed all paperwork with Joseph (finance manager) and waited for the car, on the grounds that the car was ok when we took physical possession. They were missing the extra key and the sticker. We stated we could stay an extra night in Oak Lawn and wait for the key but Joseph and Pete Schraeger insisted that they would just ship the key and the sticker when it arrived but they would ship that as well.
We left the dealership late that afternoon heading back to Texas. We began our return home and the car started making funny noises and was not shifting properly about 30 minutes into our drive. Also, the MSDS was not engaging, which the MSDS was a major factor in our purchasing this car since it would give us better gas mileage with the 5.7 liter engine. The tire light was also illuminated. The Bluetooth feature of the Navigation system was not working, the radio station reception was lacking (also part of the Navigation system) and the associated buttons to the stereo on the steering column were not working. We stopped the car, called and returned to the dealership and told them we were on the way back.
On the way back to the dealership we called the Navigation manufacturer and learned that the Bluetooth capability required an additional part and the lack of radio station reception was due to improper installation. We then called Pete Schraeger on his cell phone then called Joseph at Ed Napleton Dodge and were told they would check on the issue. Once we returned to the dealership Joseph said they were out of that part, that they would order it and they would just ship it out with the rest of the parts.
** The only part that we have received to date (1/5/09) is the tuner for the Supercharger. This is the only part we did not initially request. It was sent to fix the improper tune that Pete Schraeger had programmed.
On this second visit to the dealership Bill and Joseph went for a test drive in the car. The car shifted ok in 1st to 2nd but seemed to be having a problem from 2nd to 3rd and 3rd to 4th. It didn’t seem to be shifting gears correctly and if you punched it the engine would get to the revelator before it shifted out. (Pete explained later that he tuned it to be close and that we could move it to a lower setting by changing the tune he put on it.) Joseph affirmed to us that the car is still under warranty and just watch it and call them if the car continues to not sound right. Joseph stated that it might just need the tune tweaked. We also reported that the MSDS was not working as advertised. Joseph said he called their representative at Vortech and that it indeed was working but would not show on the indicator screen due to having a Supercharger. He also stated it could be that it has to get accustomed to our driving habits. Bill explained that we have driven other Chargers with the 5.7 MSDS and it only took a few moments to get used to our driving habits and the MSDS option was activated. Before we left Ed Napleton Dodge the second time Joseph assured us that even though we lived over 800 miles away, our warranty would be valid through Chrysler and Vortech. We were given several examples of previous instances where warranty work was done out of state. Joseph said to drive it home and if we are still having problems then let them know and they would take care of it.
Joseph stated that the MSDS should engage once we got out of town and onto the highway. We tested this on the return trip and it never engaged. We called the Ed Napleton Dodge dealership on our way home and Pete Schraeger stated that the MSDS does engage but the indicator screen does not show – this is also what Joseph stated. However, this is inaccurate as we called Vortech and they stated that the MSDS should work and will be indicated on the screen. The Vortech representative checked the serial # and they did have it on record that it was sold to Ed Napleton Dodge. They also stated that they did not have a tune for a 2008 Dodge Charger available at this time – it would not be out until around January 2009. They also stated that the dealership must have installed their own tune and it must be improperly installed due to our symptoms. We received negating answers from Ed Napleton Dodge and Vortech. We had a sinking feeling from here on out. We called Ed Napleton Dodge numerous times on the return trip home and Joseph/Pete Schraeger kept reassuring us that they would take care of it.
Before leaving the dealership the mechanic in Oak Lawn, IL, checked the tires as the tire malfunction light was indicated. He told us that it the air pressure was correct, must be a faulty sensor light and that we could have our home Dodge dealer replace the sensor as it was under warranty.
Pete Schraeger at Ed Napleton Dodge also stated numerous times that the second car key, the Bluetooth adapter, Daytona Sticker, rim key, and the additional Navigation parts would be shipped once received.
We returned to Texas late Friday, November 21, 2008. On Sunday, November 23, 2008 the engine light illuminated. We took the car Monday morning to our local Dodge Dealer – Hebert’s Town and Country in Shreveport, LA. The engine light and the tire light were both on. Angela asked that they look into this issue. Stan from Hebert’s called to report that there was a major engine malfunction; he also followed up with an email.
Bill called Pete and the Dealership to notify them of the engine problems and find out what to do next. He was unable to reach them and left a message. Pete, or anyone for that matter, did not call us back. Bill finally got a hold of Pete Schraeger and he stated that we needed to bring it to a supercharge friendly dealership and that they are trying to locate one for us. We called him back and he stated that he had found a dealership in Dallas. We called this Dallas dealership and they stated that Vortech never warranties their supercharger. We called Napleton Dodge and Pete stated that he had worked everything out with Dodge and instructed us to take it to Dallas. We then called Vortech and they said that the Dallas dealership is a good place to send it but Vortech hasn’t committed to paying for anything.
We took the 2008 Dodge Charger to another local dealer – Patterson Chrysler Jeep Dodge in Marshall, TX. They determined that all the tire sensors were improperly installed causing them to malfunction and Dodge would not warranty the tires because Ed Napleton had them installed after market.
By looking at our phone records you can see that numerous calls were made to Ed Napleton Dodge and our salesman Pete Schraeger to inform them of the problems we were having with the car. Angela also sent several email communications via the Ed Napleton Dodge website hoping to garner a response. Again if you refer to our phone records you will notice that 97.5% of the calls were outgoing from us to the dealer and/or salesman. Only twice in the 80 calls did we receive a return call.
During the conversations that we initiated we were informed by Pete Schraeger and the Ed Napleton Dodge Dealer that our car is not under warranty and the problems that the car was experiencing was our responsibility. Again, we fully believed that this car was under warranty from both the Chrysler Corporation and Vortech and were assured by Joseph and Pete Schraeger that Ed Napleton Dodge would take care of any problems by Joseph.
Finally, Joseph the finance manager stated “It doesn’t matter what I said … it’s what we put on paper! That it was a used car and that we purchased it as is … and that we signed some paperwork stating that! And that we could not sue them because they had us sign something that said we had to arbitrate … “ We instructed Joseph to begin the arbitration process. Joseph stated that he would check on it and call us back. As expected he did not call us back. Bill called him back 2 days later and he said it was a used car so we did not get an arbitration process.
In conclusion, we bought a car from a 5 star Dodge Dealership that told us we had a 3-year warranty. We asked several times before leaving the dealership to verify that we had a warranty. We even asked again when we returned with the car 1 hour after leaving because it was already showing problems. They reassured us and reassured us that we have a 3-year warranty. We offered to stay in town so the Napleton Dodge Dealership could repair the car. We were told to return to our home dealer and have the car repaired at that time. We bought a car with 600 miles and drove it straight from the Chicago Dealer to our home dealership and found out that the car had more problems than we initially had thought. We have talked with several dealerships and feel that the car was broken when we purchased it. In essence we were sold a broke car with no warranty. The car drives ok when driven slowly but the more it is driven the worse it gets. If we were to keep driving the car in the present condition it would be inoperable. We were promised that we had a warranty and that they would take care of us. And not only do we have a car with a blown up engine we still don’t have the parts that they promised to send us.
So here we are. I have lost many tears over this and have caused more stress in my marriage and life in general. Now after sending it to a Pro shop it appears that this dealer was correct the belt is damaged and the #1 piston was tore up.
