If you purchased a used vehicle from an Alan Vester dealership between February 7, 2002 and March 12, 2010 and your transaction included a dealer rebate, you may be eligible to receive a payment from a Class Action Settlement.
This lawsuit, Clark v. Alan Vester Auto Group, Inc., Case No. 06-CVS-141, was filed against Alan Vester Management Company and the Alan Vester North Carolina dealerships on behalf of customers who purchased used vehicles from North Carolina Vester dealerships that came with a ?dealer rebate? which Plaintiffs allege was a falsified down payment. The Plaintiff contends that the Vester Defendants and the designated dealerships improperly overcharged consumers as a result of using ?dealer rebates? and that the Vester Defendants? practices were unfair and deceptive. The Plaintiff is seeking damages and refunds for consumers who received ?dealer rebates.? The Vester Defendants contend that their sales practices were fair and lawful and that the use of rebates is legal and that consumers are not entitled to damages or refunds. Alan Vester Management Company and the Vester dealerships vigorously deny each of these allegations. However, to avoid the risk and uncertainty inherent in litigation, Defendants have elected to settle this case.
