On 04/11/2010, I went to the Vancouver, WA Hyundai dealership, in the company of two friends, in order to purchase a vehicle I had received a quote for via email. At first the experience was fine, I test drove the vehicle and then entered the building to begin final negotiations.
During the negotiations the sales person told me that she wanted me to fill out the top part of a credit application (name, address, social security number) so that the dealership would know how I wanted the car titled. She also informed me that I would need to sign the credit application for this purpose.
I told her that I would be happy to provide the information requested for DMV purposes, but that I did not want a credit check run on me as I would not be financing the vehicle. She told me that it was standard procedure to run a credit check and I told her again that I did not want one run for me.
She assured me that a credit check would not be run because I had requested that it not be run. I then filled out the form as she requested and wrote on the form in two places (in an area above my name, and immediately under my signature) “No credit application.” In this way I informed the sales person, both verbally and in writing, that I did not want a credit check run on me.
The first sales person left and then a little while later another sales person came in and informed me that they had run a credit check on me. When I asked why a credit check had been run when I had stated both verbally and in writing that I did not want a credit check run this sales person pretended ignorance. When I pointed to the two places on the form where I had written that I did not want a credit check run, the sales person told me that the manager had run it not him.
I asked to speak to this manager, whose name I was informed is “Jim,” and was told that the sales person would go speak with “Jim.” The two sales people returned without “Jim” and offered a perfunctory apology and then attempted to proceed with negotiations.
I reiterated that I wanted to speak with the manager who had run my credit when I had repeatedly stated I did not want my credit run, and the male sales person told me that since I had offered to pay with a personal check they had to run a credit check to make sure that my check would not bounce. When I pointed out that they could have either contacted my bank to confirm sufficient funds were available or declined a personal check in favor of a bank check (something that I would have been happy to provide) rather than violate my privacy, he told me that it was illegal to sell a car without running a credit check. I again asked to speak with this mysterious manager “Jim” and the two sales people said they would get him and left.
A short while later a new man came into the room. I asked if he were “Jim” and he said no and provided another name (I believe it was “Steve” but I am not certain). He said that he was with the finance department and that he was required to run a credit check on me because it is illegal to sell a car without running a credit check (amazingly enough I was able to purchase a car from a different dealership without having my credit checked).
I told “Steve” that I wanted him to show me this law in writing. “Steve” then became hostile and said that he would not do that, but that there was a book located somewhere in the dealership which contains pictures of terrorists and that he needed to make sure I was not in that book. I again asked to see this supposed law about credit checks in writing, and he said he would come back with the book of pictures.
“Steve” returned waving a piece of paper around and pointing at it saying that it showed a federal database of terrorists and that he had run my credit to make sure that I was not in the database. I attempted to take hold of the paper so that I could see what “Steve” was talking about, but when I touched it he grabbed my hand and squeezed my fingers and yanked the paper away from me. He told me that I was not allowed to have the paper. Since attached to the paper, which I was apparently not allowed to look at, was the credit application form, I asked him if I was “allowed” to have a copy of the form. He said yes and that he would make a copy for me and then he left.
“Steve” did not return; however, the female sales person came back into the room and I asked her for a copy of the form and a copy of the “Customer Bill of Rights” which I had signed and which had been violated multiple times in multiple ways by employees at this dealership.
The sales person returned with copies of the forms that I had requested and my friends and I left. As we were leaving, one of my friends spoke with the male sales person and said that she was very disappointed at the way we had been treated and that she felt that when “Steve” grabbed and squeezed my hand to get the paper away from me it was tantamount to assault. The male sales person laughed at us and then asked if it was assault when someone shakes our hand. When we attempted to explain what we were talking about he just laughed more and said “have a nice day.” At that point we left the dealership. I never was permitted to speak with the mysterious “Jim.
