In July 2009, our family purchased a new Subaru Outback Ltd from a Kentucky-based Subaru dealer near Lexington. Because we wanted a particular color, the vehicle was the object of a dealer to dealer trade between Wyatt Johnson and the Kentucky Subaru dealer. Whe Wyatt Johnson received the vehicle from Subaru of America they performed certain services and added a dealer invoice, posted under the manifest invoice of $2,000 above the MSRP. The clean-up crew for the Kentucky-based dealer discarded the Wyatt Johnson invoice. When I learned that this invoice was missing, I phoned Wyatt Johnson to explain the problem and request a duplicate invoice. The request was denied by Wyatt’s Sales Manager. I was stunned by this very anti-consumer stance. I phoned Bob Weaver of the Tennessee Automobile Association who told me to call one of Wyatt Johnson’s owners. During this call, I was promised an invoice listing the services that had been performed on the vehicle while it was in their care, custody, and control. Three and one-half months have passed and I have not received the invoice.
This fact left me with no option but to file consumer complaints against Wyatt Johnson with the TN Automobile Association, the TN Department of Consumer Affairs, the TN Motor Vehicle Association, the TN Department of Consumer Affairs, the TN Motor Vehicle Association, and the Mid-TN BBB.
I also requested assistance from Subaru of America whose representative agreed that only Wyatt Johnson can produce the invoice for services they provided. Wyatt Johnson claims that in a dealer to dealer trade the consumer is not entitled to information about actions they have taken with the vehicle. We refute their position. By modifying the vehicle and performing certain unknown services to the vehicle, Wyatt Johnson must disclose what was done to the vehicle. Wyatt Johnson is the only party that can provide this vital consumer information since neither the Kentucky dealer nor Subaru performed these services.
Wyatt Johnson must be held accountable to the buying public on any new cars that originate from their dealership, including cars going out of state to other Subaru dealers. Our monies were used to purchase this vehicle
directly from Wyatt Johnson. The fact that this was a dealer trade should not lessen their obligation or diminish their duty to disclose this necessary consumer information. Based on my consumer experience with Wyatt Johnson, I would not recommend that anyone purchase a vehicle from them. If we have this much trouble obtaining a simple disclosure which costs them nothing to provide, I can only imagine the difficulty solving larger problems with them.

Mr. Stewart has never been to Wyatt-Johnson. We have never sold this man a car. He continues to harass us. All 6 agencies he has contacted in the last 6 months agree with Wyatt-Johnson- Mr. Stewart bought a car in Lexington, KY and it has nothing to do with our dealership. The paint and fabric protection warranty we give is only for our customers.
